Rules & Regulations for Study Permit

The Canadian government ensures certain rules and regulations to accept your application for the study permit. If your application for a study permit has been rejected, you may have failed to provide satisfactory evidence to the visa officer.

  • The first and foremost requirement is proof of finances, which means that one can fully afford his/her own studies without recourse to public funds. Besides this, evidence is required that you are also eligible to hold your expenses while you stay in Canada during your studies.
  • Secondly, you are required to show evidence that you are eligible to take care of your family that is with you during your stay. The family here includes the spouse and children (if any).
  • Proof of acceptance from any DLI in Canada.
  • Proof of identity, i.e. your passport and pictures. (Note: some evidence details might vary from country to country)

As mentioned earlier, the study permit is optional for short courses, i.e. courses for six months or lesser. But after the completion of the course, you need to apply for a study permit if you wish to stay in Canada and continue to study. You need not apply for a separate work permit to work off-campus, along with your study permit application, as you may be allowed to work part-time, i.e. 20 hours per week during your course of studies in Canada. You may not be allowed to work off-campus if you are primarily coming to study English or French language but may be entitled to work on campus provided if student is in the tenure of a study permit. Sometimes institutes offer part-time jobs to their students, which don’t require a work permit.

Financial proof for Study Permit

You must prove that you can take care of yourself and your family (spouse and children, if any) who accompany you during your stay in Canada. By showing some of the following documents, you will be able to prove to the visa officer that; you hold enough assets to support you while you stay in Canada. 

  • Bank statements of the last 4-6 months
  • A letter of evidence from any institution or person offering you money
  • Proof if you have funded scholarship within Canada or a funded Canadian program
  • Proof of educational loan from an institution
  • Proof of payment of tuition and accommodation fees
  • Proof of a Canadian bank account in your name if money has been transferred to Canada

Apply for Study Permit from Within Canada

To be able to apply for a study permit Canada from within Canada, the following conditions must be fulfilled:

  1. You must be a minor child in primary or secondary school.
  2. You must be an exchange/visiting student.
  3. You are a spouse/common-law partner who is being sponsored 
  4. You have a Temporary Resident Permit (TRP) valid for at least six months.
  5. You have a study permit from a visa office abroad before entering Canada.

Study Visa from Outside of Canada

To obtain a study permit from outside Canada, individuals have two choices: apply online or file a paper application through the Visa Application Centre (VAC). Kindly keep in mind that neither direct student stream (SDS) be applied from within Canada nor can it be applied as a paper application. It must be applied from outside of Canada and online only. To apply online, either for a regular student visa or through SDS, one must upload all transcripts and educational degrees online and be able to make an online payment with a valid credit card.
Before applying for a study permit, you must have an offer letter from a designated learning institute (DLI). You require a valid passport and travel documents. You must also show proof of finances for your study, including tuition fees and living expenses. You must have a clean criminal record and offer a police certificate. You must also be in good health and free from serious health issues. To secure a visa, one must be able to convince the immigration officer that he/she will leave Canada upon completion of one’s studies.

    If you are interested in this program, you must work with a designated agency. This agency will issue you a letter of recommendation if you meet the requirements.

    You will then have to submit your letter of recommendation with their Expression of Interest (EOI) through the AINP Portal.

    Minimum Requirements:

    • A minimum of six months of full-time work experience of managing and/or owning the business;
    • Must have a business plan with projected financials;
    • Must have a post-secondary education from a foreign institution, and have an Educational Credential Assessment (ECA). The degree must have been completed within the last ten years;
    • A 10-minute slides-only presentation that explains the business and details what an investor what want to see;
    • A minimum Canadian Language Benchmark (CLB) level of 5;
    • Must have at least 34% ownership if the business is located in an urban centre, or at least 51% ownership if located in outside Calgary or Edmonton;
    • Must make a minimum investment of $100,000 for an urban centre, or $50,000 for a regional area. More points are awarded for higher investments. These can be made from your own equity, or from a recognized Canadian financial institution, venture capital or angel investment firm;
    • Must have a letter of recommendation from an AINP-approved agency;
    • Must have enough money to set up their business and support yourself and your family in Canada.

What is the New Brunswick Provincial Nominee Program?

The New Brunswick Provincial Nominee Program (NBPNP) is a program that allows New Brunswick to nominate immigrants to fill the economic and labour market needs of the province.

Does New Brunswick have an immigration stream aligned with the federal Express Entry immigration selection system?

Yes, New Brunswick has an immigration stream aligned with the federal Express Entry immigration selection system, also referred to as an enhanced Express Entry stream. This stream is called New Brunswick Express Entry Stream. By receiving an enhanced provincial nomination from this stream, candidates receive an extra 600 Comprehensive Ranking System (CRS) points, resulting in an Invitation To Apply (ITA) for permanent residence being issued at a subsequent draw from the Express Entry pool.

How does the New Brunswick Provincial Nominee Program work?

Applying to the NBPNP is a two-step process. Candidates interested in living and working permanently in New Brunswick should first review the different NBPNP streams to determine if they are eligible.

Step 1: Once a complete application is submitted along with all supporting documentation, the processing time for eligible applications can be up to three months or more.

Step 2: Apply to Immigration, Refugees and Citizenship Canada (IRCC) for a permanent resident visa.

Within six months of receiving the nominee certificate, applicants are required to apply to IRCC in order to receive a permanent resident visa. Applicants, along with their spouse/common-law partner and dependents, if applicable, must meet all requirements for medical, security and criminal admissibility. IRCC has the final authority to issue a permanent resident visa.

Is an individual required to live and reside permanently in New Brunswick once he or she immigrates?

As part of any PNP application, applicants are required to submit a Settlement Plan indicating why they wish to live in the province and how they intend to settle. Applicants are also required to sign an ‘intention to reside’ document with their application. That being said, the Canadian Charter of Rights and Freedoms ensures that all Canadian citizens and permanent residents are allowed to work and reside in any location across Canada. Once an individual obtains Canadian permanent residence, he or she has the right to work and reside in any Canadian province or territory.
